Welcome to TheLMSGeek! These Terms and Conditions govern your use of our consultancy services for building websites using LearnWorlds. By engaging with our services, you agree to abide by these terms. Please read them carefully before proceeding.

1. Services Provided TheLMSGeek offers consultancy services related to website creation and optimization using LearnWorlds. Our services include, but are not limited to:

  • Website setup and customization
  • Course structuring and organization
  • Integration of third-party tools
  • Performance optimization
  • Technical guidance and best practices

2. Client Responsibilities To ensure a smooth collaboration, clients are expected to:

  • Provide accurate and timely information required for website setup
  • Have an active LearnWorlds subscription or obtain one before the consultation
  • Clearly outline project requirements and expectations
  • Respond to queries and provide necessary approvals in a timely manner

3. Payment Terms

  • Pricing for consultancy services will be outlined in a formal agreement or invoice.
  • Payments must be made as per the agreed-upon schedule.
  • Failure to complete payment may result in service suspension or termination.
  • All payments are non-refundable unless otherwise stated.

4. Refund Policy

  • Refunds are only considered in cases where TheLMSGeek fails to deliver the agreed-upon services due to unforeseen circumstances on our part.
  • Refund requests must be submitted in writing within 7 days of the service completion date.
  • If a refund is approved, it will be processed using the original payment method.
  • Partial refunds may be considered if some services have already been delivered.
  • Chargebacks or disputes filed without prior communication may result in a ban from future services.

5. Intellectual Property

  • Any custom work, configurations, or recommendations provided remain the intellectual property of TheLMSGeek unless otherwise agreed.
  • Clients retain ownership of their website and any content they provide.

6. Limitation of Liability

  • TheLMSGeek is not responsible for any technical issues arising from LearnWorlds’ platform.
  • We do not guarantee specific results, as success depends on various factors outside our control.
  • Under no circumstances shall TheLMSGeek be liable for indirect, incidental, or consequential damages.

7. Confidentiality

  • Both parties agree to maintain strict confidentiality regarding any sensitive information shared during the consultancy process.
  • TheLMSGeek will not disclose, share, or use any client-provided data for any purpose other than delivering the agreed-upon services.
  • Any confidential materials, strategies, or project details exchanged between parties will remain strictly protected and will not be shared with third parties without explicit written consent.
  • Clients are also expected to keep any proprietary information shared by TheLMSGeek confidential.
  • Any breach of confidentiality may result in immediate termination of services and potential legal action.

8. Post-Completion Modifications

  • Clients are entitled to up to five (5) free updates or modifications on services that are incomplete as compared to the initial request.
  • Requests for these modifications must be submitted within 14 days of project completion.
  • Any additional modifications beyond the five free updates will be subject to additional charges.
  • Modifications do not include new features or changes beyond the original scope of work.

9. Termination

  • Either party may terminate the agreement with written notice.
  • In the event of termination, any completed work must be paid for.

10. Amendments

  • TheLMSGeek reserves the right to update these Terms and Conditions at any time.
  • Continued use of our services constitutes acceptance of any changes.
